Please read the following Terms and Conditions carefully as these Terms and Conditions govern your use of and participation in the Starfish Discount Programme.

By joining the Starfish Discount Programme, you accept and agree to be bound by these Terms and Conditions.
- Eligibility
The Starfish Discount Programme is only available to New Zealand residents who are Airpoints™ members. The Airpoints Programme joining fee will be waived for non-Airpoints members who purchase a Starfish Discount. To qualify for the waiver, you must enter the promo code 'STARFISH' when joining the Airpoints Programme online at www.airnewzealand.co.nz/join-airpoints. - Discount Options
- 2.1
- There are two types of Discount products that are available under the Starfish Discount Programme:
Option One: 15% Discount which can be purchased for $200 (including GST); or
Option Two: 30% Discount which can be purchased for $800 (including GST). - 2.2
- You may hold only one type of Discount at any time and once purchased, you can not request an upgrade to a higher Discount or downgrade to a lower Discount.
- 2.3
- Up to 2 months before the expiry of your current Starfish Discount, you can renew your membership online via myairnz. At the time of renewal, you can change to a higher or lower discount product. Your new Discount rate will apply from the date after the expiry of the current Starfish discount.
- 2.4
- The joining fee that you pay to belong to the Starfish Discount Programme is non-refundable. Nothing contained in these Terms and Conditions shall affect any rights you may have under the Consumer Guarantees Act 1993 if it is applicable.
- Validity Period
If you are a new member, or if your existing membership has expired and you are re-joining Starfish, your Discount will be activated on the Date of Purchase and is valid for a period of twelve (12) months from the Date of Purchase ("Initial Validity Period"). If you are renewing your Starfish membership, your renewed Discount will be activated from the Date of Renewal (being the day after your current Starfish membership expires), and will be valid for a period of twelve (12) months from the Date of Renewal ("Renewal Validity Period"). All travel must be commenced and completed within the validity period to be eligible for the Discount. - Use of Discount
- 4.1
- The Discount is personal to the Discount Holder and is not transferable. The Discount Holder must not attempt to sell, transfer or assign their Discount to anyone else nor must the Discount Holder use their Discount to purchase discounted flights for persons other than the Discount Holder.
- 4.2
- Once you have joined Starfish, you will be issued with an ePass™ (unless you already have one) which is a small token that can be affixed to the back of your phone or carried on you when travelling. You must scan this ePass at the Air New Zealand self-check kiosk (if available) or at the boarding gate when travelling to confirm your identity. Passengers may also be required to provide other forms of identification prior to or at the time of boarding in order for us to verify that the person travelling is the Discount Holder. Without limiting any of our rights or remedies, if someone else presents a Ticket issued in your name for travel and we discover that that person is not you, we will refuse to carry that person. In addition to these Terms and Conditions, your use of the ePass is governed by the ePass terms and conditions referred to at section 9.2 below.
- 4.3
- The Discount is only valid on Qualifying Flights booked in the name of the Discount Holder. To obtain the Discount on Qualifying Flights, you must log in to your myairnz account via www.myairnz.co.nz or www.airnewzealand.co.nz before booking the Qualifying Flights. The Discount can not be applied if you are not logged in to your myairnz account when booking your Qualifying Flights. Alternatively, your travel agent may book Qualifying Flights on your behalf via Air New Zealand's travel agent portal at www.airnzagent.co.nz. Your travel agent will need to enter your Airpoints number and registered email address when booking your Qualifying Flights. Any disputes relating to the use of any personal information provided by you to your travel agent are not the responsibility of Air New Zealand. Air New Zealand has no liability for any misuse (fraudulent or otherwise) of any personal information you choose to provide to a third party relating to your Airpoints account.
- 4.4
- The Discount will be applied at the time the fare is quoted online. The Discount is calculated on the full adult fare (inclusive of GST) for the Qualifying Flights selected and is rounded to the nearest dollar.
- 4.5
- The Discount does not apply to any fees or charges payable or any additional services provided in connection with a Qualifying Flight or to any other products or services offered by Air New Zealand or its partners.
- 4.6
- The Discount can not be combined or used in conjunction with any other discount or promo code offer.
- 4.7
- There is a limit of one adult passenger per booking under the Starfish Discount Programme. This means that a separate booking will need to be made for any adult passengers who may be travelling with you (even if they also hold a Starfish Discount). You are able to include Infant and Child passengers who are travelling with you on the same itinerary in your booking, however, the Discount will only apply to Qualifying Flights booked in your name.
- 4.8
- Where you have renewed your Starfish membership and have changed Discount levels, the following additional rules will apply to your use of the Discount:
- If a Qualifying Flight is purchased during the Initial Validity Period and your return journey is subsequently changed to a date in the Renewal Validity Period, the Discount that applied in the Initial Validity Period will continue to apply.
- If you make a return booking with an outbound travel date in the Initial Validity Period and a return travel date in the Renewal Validity Period, the Discount that applied in the Initial Validity Period will apply to the entire booking.
- Booking Cancellation and Changes
- 5.1
- Booking Cancellations
Bookings made under the Starfish Discount Programme can be cancelled online at www.airnewzealand.co.nz or through the Contact Centre. Refunds will be subject to the applicable fare rules and cancellation fees and/or service fees may apply. Please note that some fare types are non-refundable. - 5.2
- Booking Changes
Bookings made under the Starfish Discount Programme can only be changed through the Contact Centre. Changes will be subject to the applicable fare rules and a change fee may apply. Notwithstanding the foregoing, the Contact Centre service fee will be waived for changes to bookings made under the Starfish Discount Programme. If a Qualifying Flight is purchased and subsequently changed to travel outside the validity period of your Starfish Discount, a new fare will need to be purchased at the applicable full fare level. - 5.3
- Booking Change Rules
- If a Qualifying Flight is purchased and subsequently changed to travel outside the validity period of your Starfish Discount, a new fare will need to be purchased at the applicable full fare level.
Where you have renewed your Starfish membership and have changed Discount levels, the following additional rules will apply to any changes to Qualifying Flight bookings:
- If a Qualifying Flight is purchased for travel during the Initial Validity Period and is subsequently changed to travel entirely in the Renewal Validity Period, the Discount that applied in the Initial Validity Period will continue to apply.
- If a Qualifying Flight is purchased for travel during the Renewal Validity Period and is subsequently changed to travel in the Initial Validity Period, the Discount that applied in the Renewal Validity Period will continue to apply.
- Privacy
- 6.1
- We collect personal information about you when you join Starfish and use any of the services provided to you under the Starfish Discount Programme. Personal information includes your name, Airpoints number, travel details and/or purchases of goods and/or services. If you do not provide us with this information then we may not be able to provide any services that you have requested.
- 6.2
- We may use the personal information we collect:
- to process any communications you request
- to administer the Starfish Discount Programme
- to facilitate your participation in the Starfish Discount Programme
- to conduct surveys and internal research
- to comply with laws and regulations in applicable jurisdictions
- to identify and present offers from us or form third parties that may be of interest to you
- facilitating security checks
- any other use that you authorise
- 6.3
- We may share your personal information with third parties (such as data processing or market research organisations, or government agencies) for any of the purposes described here. Where possible we will require these third parties to strictly comply with our instructions and not use the information for any other purpose. We will not disclose your personal information to any other third party without your consent.
- 6.4
- Without limiting clauses 6.2 and 6.3 in anyway, by providing us with an electronic mailing address or postal address, you authorise us to send programme communications, special offers, product updates to you using that electronic mailing address, or postal address (as applicable). The collection, storage and use of your personal information is subject to Air New Zealand's Privacy Policy which can be viewed at www.airnewzealand.co.nz and is also subject to all applicable laws including the Privacy Act 1993 (New Zealand). You have the right to access your personal information recorded by us and have it updated or corrected as necessary.
- Termination and Suspension
- 7.1
- Without limiting any of our rights or remedies, if you breach these Terms or Conditions, or in the exercise of our reasonable discretion, we decide or establish that you have used your Discount improperly or fraudulently, you'll be subject to appropriate administrative and/or legal action by Air New Zealand that includes, but is not limited to, termination or suspension of your Discount and membership in Starfish, and cancellation of any unused flights purchased under the Starfish Discount Programme, without compensation to you. We may also take action to recover the monetary value of any Discount obtained improperly or fraudulently and any legal fees (on a solicitor/client basis) and/or other costs which we may incur in recovering amounts you owe.
- 7.2
- Air New Zealand reserves the right, at its discretion, to modify, suspend, or terminate the whole or any part of the Starfish Discount Programme at any time, including (without limitation) if for any reason the Starfish Discount Programme is interfered with or disrupted in any way (including, but not limited to, by power shortages or failures, natural disasters, acts of God, civil disturbance, strikes, terrorist activities or war, computer bugs or viruses, tampering or technical failures). To the extent permitted by law, we will not be liable to you for such modification, suspension or termination.
- Amendment Air New Zealand reserves the right to amend these Terms and Conditions at any time, in its sole discretion. Any amendments to these Terms and Conditions will be effective immediately upon posting on our website, www.airnewzealand.co.nz/starfish. You'll be deemed to have accepted any such amendment if, after we have given this notice, you use your Discount.
- General
- 9.1
- Qualifying Flights and regional routes may be seasonal and are subject to change without notice at any time.
- 9.2
- In addition to these Terms and Conditions, your use of the ePass that you have been or will be issued with is subject to the following terms:
- When you first use your ePass you agree to these terms and conditions, as amended from time to time by us.
- You must not allow others to use your ePass. We may require proof (to our satisfaction) of your identity when you use your ePass.
- You must notify us immediately if your ePass is lost or stolen by calling 0800 737 000.
- Your ePass is Air New Zealand's property and may be retained by us. Your ePass must not be copied, modified, tampered with or reproduced in any way. You agree to return or destroy your ePass when we ask you.
- You will be liable for all losses, including any consequential or special losses suffered by a third party if you act fraudulently, either alone or together with any other person. You may be liable for some or all losses arising out of any unauthorised use of your ePass, whether occurring before or after notification, if you have caused or contributed to the loss.
- We may at anytime, suspend operation of your ePass and/or cancel your right to use your ePass.
- 9.3
- In addition to these Terms and Conditions, all travel purchased under the Starfish Discount Programme is subject to Air New Zealand's Conditions of Carriage and the fare conditions applicable to the fare purchased.
- 9.4
- If you acquire or hold yourself out as acquiring for the purposes of a business any services to which these Terms and Conditions apply, the provisions of the Consumer Guarantees Act 1993 (New Zealand) shall not apply to our supply of such services.
- 9.5
- These Terms and Conditions are governed by and construed in accordance with the laws of New Zealand and any dispute arising with your use of or participation in the Starfish Discount Programme is subject to the exclusive jurisdiction of the courts of New Zealand.
- Definitions
The terms used in these Terms and Conditions have the following meanings:- "Air New Zealand", "we", "our" and "us" means Air New Zealand Limited.
- "Air New Zealand Link" means Mount Cook Airline Limited (excluding Mount Cook Airline Scenic Flights), Air Nelson Limited and Eagle Airways Limited.
- "Air New Zealand Operated Services" is a journey taken only on a Flight and Flight number that is ticketed and operated by Air New Zealand, Air New Zealand Link and/or Zeal 320 Limited.
- "Child" is a person between the age of two and twelve years old (inclusive).
- "Date of Purchase" is the date you purchase the Starfish Discount.
- "Date of Renewal" is the date on which your renewed Starfish membership commences, being the day after your current Starfish membership expires.
- "Discount" means the applicable percentage discount that the Discount Holder is eligible to receive, in accordance with these Terms and Conditions, on Qualifying Flights.
- "Discount Holder", "you" and "yours" means the person who has purchased a Starfish Discount and whose name is recorded by Air New Zealand as the designated discount holder.
- "ePass" is an electronic boarding pass issued to Discount Holders that uses frequency identification-enabled technology to enable self-scanned check in and boarding at domestic airports by Discount Holders.
- "Flight" is defined as a single flight or a series of connecting flights (having one or more flight numbers) from an origin to a destination on a specific date with specific departure time(s).
- "Grabaseat Fares" means any promotional fares offered by Air New Zealand on the grabaseat website www.grabaseat.co.nz.
- "Infant" is a person less than two years old.
- "Non-Qualifying Fares & Tickets" means $1 and Standby Grabaseat Fares; Child and Infant fares; Tickets issued for charter flights; travel industry-rebated Tickets; Tickets purchased using Fly Buys points; Tickets acquired at auction; discounted Tickets; Tickets not issued in your name (even if paid for by you); or any other Tickets that we may specify from time to time.
- "Qualifying Flight" is defined as a New Zealand domestic Flight on an Air New Zealand Operated Service that originates from or departs to a Regional Airport, excluding domestic Flight sectors that are booked as part of an international journey and direct Flights between the following cities: Auckland, Wellington, Christchurch, Queenstown and Dunedin. Qualifying Flights do not include travel on Non-Qualifying Fares & Tickets.
- "Regional Airport" means the domestic airport terminals located in Blenheim, Gisborne, Hamilton, Hokitika, Invercargill, Kaitaia, Kerikeri, Masterton, Napier, Nelson, New Plymouth, Palmerston North, Rotorua, Taupo, Tauranga, Timaru, Wanaka, Wanganui, Whakatane, Whangarei, and Westport.
- "Starfish" or "Starfish Discount Programme" means the programme operated by Air New Zealand to provide certain discounts on Qualifying Flights for the use and benefit of Discount Holders.
- "Terms and Conditions" means these terms and conditions, between Air New Zealand and each Discount Holder, as amended or replaced from time to time at the sole discretion of Air New Zealand.
- "Ticket" is the paper flight coupon(s) that entitles a passenger to be carried on a specified air service, and it includes electronic ticket receipt(s) that identify carriage on a specified air service.
