Air New Zealand cargo - conditions of sale for animal cages

All products (Products), including without limitation animal cages, are sold by Air New Zealand Limited whose registered office is at 185 Fanshawe Street, Auckland, New Zealand (Air NZ) and are sold to the purchaser subject to the conditions of sale set out below.

1.1 By selling the Product to the purchaser, Air NZ does not guarantee any freight services. Any such services must be arranged and paid for with Air NZ separately and will be subject to Air NZ’s conditions of carriage cargo.

1.2 Air NZ does not guarantee that the Product will meet Air NZ’s cage requirements (such as fleet hold size and/or capacity on any particular flight), or IATA requirements, for cargo or baggage on any date in the future on which the purchaser wishes to use the Product for carriage of any animal, on Air NZ or any other carrier. The current requirements can be found at travelling with pets.

1.3 Air NZ makes no representation that such requirements will apply on the date of carriage booked by the purchaser.

1.4 The purchaser must ensure prior to carriage that the Product is suitable for the animal they are planning to ship and make themselves aware of all Air NZ and IATA requirements at that time. For more information, refer to travelling with pets.

2.1 Air NZ will not be liable, to the extent permitted by law, in respect of any claim, loss, liability or expense (a Loss) incurred by the purchaser to the extent such Loss is caused directly or indirectly by the escape of an animal from the cage, or by the cage itself.

2.2 Air NZ shall not be liable for any loss or damage of any kind whatsoever, arising from the supply of Products by Air NZ to the purchaser, including without limitation consequential loss, whether suffered or incurred by the purchaser or another person and whether in contract or tort (including negligence) or otherwise and irrespective of whether such loss or damage arises directly or indirectly from Products provided by Air NZ to the purchaser.

2.3 Consumer Guarantees Act
The guarantees contained in the Consumer Guarantees Act 1993 are excluded where the purchaser acquires Products from Air NZ for the purposes of a business in terms of sections 2 and 43 of that Act.

3.1 Delivery will be made to the airport to which Air NZ operates as requested by the purchaser at the time the order is placed. The purchaser must arrange for the Products to be picked up at that delivery airport.

3.2 On receipt of full payment from the purchaser, Air NZ will dispatch the purchased products on the next scheduled dispatch day, which is currently every Tuesday and Friday of each week. Therefore orders placed between Friday 12:00pm and Tuesday 12:00pm will be dispatched Tuesday afternoon, and orders placed between Tuesday 12:00 and Friday 12:00 will be dispatched Friday afternoon.

3.3 If urgent dispatch of the product is required by the purchaser, Air NZ will arrange the delivery within 24 hours to the requested airport to which Air NZ operates, on receipt of an additional Express Handling Fee of $30.00 including GST per product purchased.

Risk and title shall pass to the purchaser:

4.1 In respect of Products purchase over the counter at Air NZ’s cargo offices, when the Products are paid for in full; and

4.2 In respect of Products purchased either online or over the phone for delivery to a domestic airport, when the Products are delivered and made available to the purchaser at the applicable airport.

5.1 If the product is of the wrong size and/or not suitable for the pet, a Return Handling Fee of $30.00 including GST per product will apply. The Return Handling Fee is in addition to the applicable price variation between the original product and the new product. The Return Fee is also in additional to any Express Handling Fee required for the replacement product.

5.2 In order to process exchanges, the original purchased product must be returned to the delivery airport in the same condition in which it was received. Air NZ reserves the right to decline any exchange request if there is any evidence of use or damage to the product.

The price shall be as stated on the Air NZ website, or at the counter at Air NZ’s cargo office from which the Product is purchased. The price is inclusive of GST.

All payments must be made in full, prior to dispatch of the Products.

These conditions of sale, and any disputes arising in connection with the Products, shall be governed by the laws of New Zealand and the courts of New Zealand shall be the exclusive jurisdiction.
